NON-DISCRIMINATION AND SEXUAL HARASSMENT

The Fayetteville-Manlius Central School District affirms that no person shall be excluded from participation in, be denied benefits of, or be subjected to discrimination in employment in any educational program or activity on the basis of age, gender, sexual orientation,race, ethnic background, religion, creed, country of origin, marital status, disability, or on other basis in accordance with the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act of 1973, Title IX, and other federal or state laws.

The Superintendent shall designate an Equal Opportunity Coordinator who shall be authorized to coordinate and carry out the responsibilities of the district under this section and to assure necessary compliance with the regulations and to process any grievance which may be filed in accordance with the grievance procedure heretofore adopted by the school district.

The Fayetteville-Manlius School District, consistent with the Civil Rights Act of 1964, considers harassment based on gender or sexual orientation to be an abuse contrary to the high moral ethical standards of an educational institution. Sexual harassment is constituted by unwelcome sexual advances, requests for sexual favors and other verbal or physical conduct of a sexual nature when

Submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment;

2.

Submission or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or

3.

Such conduct has the purpose or effect or unreasonably interfering with an individual's performance or creating an intimidating, hostile or offensive environment.

The Fayetteville-Manlius School District will not tolerate the use of a position of authority to obtain sexual favors in supervisor/employee or faculty/student relationships. Neither will it condone expressions or actions by any person affiliated with the school district which in any manner constitutes sexual harassment, including student-to-student harassment. Attempts to suppress the report of such actions or to retaliate for the presentation of a report will be considered in the same light as the offending behavior.

All staff involved in employee recruitment and selection shall be furnished a copy of this policy and the regulations and directed to comply with the regulations in all respects.

Disciplinary action will be taken against any student or employee found in violation of this policy.
