Facilities Agreement for Mass Care Shelters
This agreement is made and entered between the governing board of Fayetteville-Manlius High School of Onondaga County, state of New York and the Onondaga-Oswego Chapter of the American Red Cross.
Pursuant to the terms of federal statutes, the Red Cross provides emergency services on behalf of individuals and families who are victim of disaster. Fayetteville-Manlius High School is authorized to permit the Red Cross to use the buildings, grounds, and equipment for mass care shelters required in the conduct of Red Cross Disaster Services activities and wishes to cooperate with the Red Cross for such purposes.
The parties hereto mutually desire to reach an understanding that will result in making the facilities of Fayetteville-Manlius High School available to the Red Cross for the aforesaid use. Now, therefore, it is mutually agreed between the parties as follows:
- Fayetteville-Manlius High School agrees that after meeting its responsibilities to members/clients, it will permit, to the extent of its ability and upon request by the Red Cross, the use of its physical facilities be the Red Cross as a mass shelter for victims of disasters.
- The American Red Cross agrees that is shall exercise reasonable care in the conduct of it activities in such facilities. The facility will be returned to Fayetteville-Manlius High School in the same condition as it was when the shelter was opened, as indicated on the shelter opening walk-through. The Red Cross further agrees to replace or reimburse Fayetteville-Manlius High School for any food or supplies that may be used by the Red Cross while conducting its relief activities in the shelter.
- Notwithstanding any other agreements, the administration of the American Red Cross agrees to defend, hold harmless, and indemnify Fayetteville-Manlius High School against any legal liability in respect to bodily injury, death, and property damage arising from he negligence of the said disaster relief operation during its use of the property belonging to the said organization.
